When to check copywriting services UK regulations before publishing
A trigger list for UK copywriting services: when consumer, advertising and data rules bite before you publish, with the CMA, ASA, ICO and Acas named.
What to take away
- The ICO's UK GDPR guidance, alongside the Data Protection Act 2018 and PECR, sets the data baseline for copywriting services. The 2008 unfair trading rules cover the claims themselves.
- Three regimes catch most copymisleading claims, personal data, and pay statements.
- Triggers are predictablea new claim, a new data source, a new price or pay figure, or a new platform.
- This is general guidance only; individual cases need a qualified adviser.
A written claim is a commercial communication. Under the Consumer Protection from Unfair Trading Regulations 2008, misleading copy includes wording that deceives the average consumer and changes a transactional decision. That covers hidden conditions and invented comparisons, not just outright lies. The Competition and Markets Authority (CMA) and local authority Trading Standards enforce the Regulations across the UK, and business-to-business copy falls under the Business Protection from Misleading Marketing Regulations 2008.
The test is whether a reasonable reader could be misled when they decide to buy, click or instruct.
When a claim needs evidence before it ships
Check before publishing whenever copy carries a superlative, a statistic, a comparative price or a promised outcome. Each is a claim a regulator or a competitor can test.

Publish as drafted
Could you show the source to a stranger in a minute? If not, soften the wording. A team paying £400 a month for content that promises to double leads still needs a documented basis for that figure.
Comparative advertising is allowed in the UK under the Business Protection from Misleading Marketing Regulations 2008 if it is honest, like for like and verifiable. Vague superiority is not.
Substantiation is a filing habit, not a writing one. Keep the source, its date and the name of whoever approved it with the draft. Then the answer is ready if anyone asks.
Advertising copy sits under the CAP Code, written by the Committee of Advertising Practice and enforced by the Advertising Standards Authority (ASA). It applies to ads in print, online and on social media, and the ASA can act on a single complaint.
When personal data enters the copy
Case studies, testimonials, client logos and named individuals all involve personal data. The moment a draft names a real person, or carries a quote, photo or job title, data protection duties apply.
Personal data in the copy
- Names, quotes, photos or job titles present
- Recorded consent or legitimate interest assessment
- Route for withdrawal in place
- Anonymised composites genuinely unidentifiable
- Controller and processor split in the contract
- Own-drive names and contacts treated as personal data
The ICO's guidance and resources on UK GDPR set out the lawful basis, transparency and individual rights behind marketing content, and the Data Protection Act 2018 gives the regulator its enforcement powers. The Privacy and Electronic Communications Regulations (PECR) cover email, text and cookie-based marketing. Expect recorded consent or a legitimate interest assessment, plus a route for withdrawal.
Anonymised composites avoid the problem, but only if they are genuinely unidentifiable. Changing a name while keeping a distinctive role is not anonymisation.
Where you write for a client, the client is normally the controller and you are the processor, and that split belongs in the contract. Names and contact details kept on your own drive are personal data you hold in your own right.
When pay or earnings appear in content
Recruitment copy, franchise pitches and "earn £X" landing pages carry a second layer of risk. Statements about pay, deductions and minimum wage entitlement must match what the worker actually receives under the National Minimum Wage Act 1998 and the Employment Rights Act 1996.
Acas publishes guidance on pay and wages covering minimum wage compliance and deductions, which is the reference point when content describes what a role pays.
Commission promises need qualifying conditions next to the figure. Where copy describes an engagement rather than employment, the contract and the advert must agree.
Put a date and a basis next to any figure, such as an hourly rate before tax. A range is easier to defend than a single headline number.
Before and after claims
The rewrites below keep the benefit and drop the unprovable absolute.
| Before | After |
|---|---|
| Guaranteed first page on Google | We target agreed keywords and report rankings monthly |
| Cheapest copywriting in the UK | Our standard rate is £X per 1,000 words |
| Our client doubled revenue in a month | Client A reported a 100% rise; basis on request |
| Fully GDPR compliant copy | We draft against ICO guidance; your lawful basis is yours |
| Earn £3,000 a month from home | Typical engagement pays £X; earnings vary |
When to review the paperwork behind the words
Rules and contracts move together. A claim about delivery times, revisions or draft ownership is only as strong as the agreement behind it.
The commercial contracts guide sets out the terms worth settling before you sign or issue a statement of work.
Where a project touches regulated sectors, the client's compliance team should approve wording. Financial promotions are regulated by the Financial Conduct Authority (FCA), so only authorised firms may issue them. Health and nutrition claims in advertising fall under the CAP Code and the ASA, and claims about food are also subject to food law enforced by local authorities. Writers can flag risk; they cannot sign off regulated copy.
Keep a short record of who approved the final wording and when. That note is the first thing anyone asks for if a claim is challenged.
Common questions
Does UK GDPR apply to a testimonial with a client's name?
Yes, if the person is identifiable. You need a lawful basis, usually consent, and a clear statement of how the quote will be used. Record when they agreed and how they can withdraw.
Do earnings claims in recruitment copy need approval?
They must be accurate and state qualifying conditions. Check the advert against Acas guidance on pay and keep it consistent with the contract you will issue.
Who is responsible if a client supplies a misleading claim?
The publisher of the claim can be liable, not only the client. Ask for substantiation before you write it up and record that request. Individual cases need a qualified adviser.
